To Issue an Enforcement Notice at land East of Sandhills, Cattistock

Decision Maker: Officer Delegated Decision

Decision status: Recommendations Approved

Is Key decision?: No

Is subject to call in?: No

Decision:

To issue an Enforcement Notice requiring the cessation of the use of land East of Sandhills, Cattistock, for human habitation, the removal from the land of any caravans, and the removal from the land of any hardstanding, utility pipes, portaloo and other paraphernalia used in association with the human habitation of the land.

The decision to issue this Enforcement Notice is taken under delegated powers, as set out in paragraph 145 of the Officer Scheme of Delegation. These powers have been nominated to the below authorised officer.

Reasons for the decision:

The use of this land for the siting of a caravan for human habitation does not benefit from planning permission. It is considered that no evidence has been provided to justify any agricultural or other essential need for the unauthorized change of use. The use of the land for the siting of a caravan for human habitation is contrary to Local Plan policies, and the land is presently unsafe and in such poor condition that it is not a suitable or safe place for residential use. As such, it is expedient, and in the public interest, to take enforcement action against this breach of planning control.

Alternative options considered:

Officers are not aware of any exceptional circumstances which may justify not taking enforcement action in this case. As such, the alternative option of not taking enforcement action is rejected.

Interests and Nature of Interests Declared:

No members were consulted in arriving at this decision.
