Decision Maker: Officer Delegated Decision
Decision status: Recommendations Approved
Is Key decision?: No
Is subject to call in?: No
Reasons
for Decision
a)
The proposed diversion and creation meet the legal criteria set out in
the Highways Act 1980.
b)
The inclusion of these provisions in a public path means that there is
no need for a separate legal event order to modify the definitive map and
statement as a result of the diversion and creation.
c)
Accordingly, the absence of objectors may be taken as acceptance that
the proposed diversion and creation are expedient and therefore Dorset Council
can itself confirm the orders.
Alternative
options considered and rejected
None.
Decision
a) The application to divert Footpaths 15 (part) and 16. Wooton Fitzpaine and to create a new footpath in Wooton Fitzpaine be accepted and a diversion and creation order made.
