Declarations of Interest

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their decision councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

15.

Public Participation

To receive questions or statements on the business of the committee from town and parish councils and members of the public.

 

Public speaking has been suspended for virtual committee meetings during the Covid-19 crisis and public participation will be dealt with through written submissions only.

 

Members of the public who live, work or represent an organisation within the Dorset Council area, may submit up to two questions or a statement of up to a maximum of 450 words.  All submissions must be sent electronically to elaine.tibble@dorsetcouncil.gov.uk  by the deadline set out below.  When submitting a question please indicate who the question is for and include your name, address and contact details.  Questions and statements received in line with the council’s rules for public participation will be published as a supplement to the agenda.

 

Questions will be read out by an officer of the council and a response given by the appropriate officer at the meeting.  All questions, statements and responses will be published in full within the minutes of the meeting.  The deadline for submission of the full text of a question or statement is 8.30am on Wednesday 4 August 2021.

Planning Application 3/17/2480/DCC - Land at Biarswood Yard, Barrack Road, West Parley, BH22 8UB pdf icon PDF 489 KB

To consider Planning Application 3/17/2480/DCC.

Minutes:

The Lead Project Officer, Corporate Projects presented the application for continued use of the site known as Briarswood Yard, Barrack Road, West Parley in part for vehicle repair and associated sales; continued use of site in part for existing concrete contracting yard; proposed use of site in part for B8 storage and distribution; landscaping and associated works. 

 

With the aid of a visual presentation the committee members were shown the site context and advised that part of the application site was within Bournemouth, Christchurch and Poole (BCP) Council’s administrative area.  At the present time the BCP application had not been determined and it was understood that BCP were awaiting Dorset Council’s resolution before making its own decision. 

 

After presenting a description of the site and it’s varied uses the Lead Project Officer, Corporate Projects gave a detailed history of the site.  Looking closer at aspects of the site context and application proposal he felt that the Ecological Impact Assessment indicated that no significant adverse effect on the designated sites was likely and that the submitted Biodiversity Plan provided for the realisation of an overall net gain for biodiversity.  The area was in a low risk Flood zone 1 area.  Updated photographs taken in July 2021, post writing of the report, were presented showing the addition of some new curbing and a removable building. 

 

Written statements from the members of the public and West Parley Parish Council were read to the committee and the Local Ward Councillor, Cllr Parry also read a statement, these are attached as an appendix to these minutes. 

 

The committee members had the opportunity to ask questions of the Lead Project Officer, Corporate Projects which focused mainly on: 

 

·       Concerns about water run-off. 

·       What materials would be used for the bund and landscaping. 

·       Hours of operation.  

·       Noise disturbance for local residents 

·       The Certificate of Lawfulness. 

 

Following responses to questions, the committee debated the application.  Overall, there was support for the application, but concerns remained regarding hours of operation and potential noise disturbance.  It was considered beneficial for the site to be brought under planning control and the surface water would be dealt with under condition 3(iii) in the report.

The Committee were unanimously ‘minded to’ allow the application, subject to an additional condition relating to the hours of operation being from 7.00am to 7.00pm, Monday to Saturday only with no Sunday or Public Bank Holiday working. 

 

The Head of Planning declared that he had listened to the debate and all the comments and was happy to determine the application in line with the committee’s ‘minded to’ decision. 

  

 

Decision: That the application be approved, subject to the conditions outlined in the appendix attached to these minutes.

Urgent items

To consider any items of business which the Chairman has had prior notification and considers to be urgent pursuant to section 100B (4) b) of the Local Government Act 1972. The reason for the urgency shall be recorded in the minutes.

Exempt Business

To move the exclusion of the press and the public for the following item in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

The public and the press will be asked to leave the meeting whilst the item of business is considered.
