Is Key decision?: No

Is subject to call in?: No

Purpose:

To issue an enforcement notice requiring the permanent removal of scrap and building materials from land around the garages at the rear of 85-89 Cobham Drive, also known as Garages 111-116 Cobham Drive, Weymouth, DT4 0ST.

The decision to issue this Enforcement Notice is taken under delegated powers, as set out in paragraph 145 of the Officer Scheme of Delegation. These powers have been nominated to the below authorised officer.

Decision:

Approved to issue an enforcement notice requiring the permanent removal of scrap and building materials from land around the garages at the rear of 85-89 Cobham Drive, also known as Garages 111-116 Cobham Drive, Weymouth, DT4 0ST.

Reasons for the decision:

The use of this site for the storage of scrap, building materials and rubble was first reported in June 2020, and recent site visits have confirmed that the site continues to be used for storage of scrap and reclaimed building materials.

The unauthorised change of use to a scrap yard and for storage of reclaimed building materials is considered inappropriate in this residential area. The storage of materials is considered detrimental to the amenity of the area, contrary to policy ENV16 of the West Dorset, Weymouth & Portland Local Plan (2015).

The officer investigation has not identified any exceptional circumstances to suggest that enforcement action should not be taken in this case, and it is considered to be expedient, and in the public interest, to take enforcement action in order to uphold the integrity of the planning system.

Alternative options considered:

The alternative option of not taking enforcement action is not considered appropriate in this case, for the reasons set out above.
