To take no further action in respect of a technical breach of planning control concerning unauthorised internal works to a listed building.

This decision is taken under delegated powers, as set out in paragraph 145 of the Officer Scheme of Delegation, which states the following:

To undertake all action in order to regulate any actual, perceived or potential breach of any 

of the Town and Country Planning Legislation including… (f) to determine whether or not to take and/or to cease action whether because in his/her opinion the breach is trivial, there is insufficient demonstrable harm and/or, it is not expedient to take / continue to take action.

This delegated authority has been passed to the decision maker through the ‘Local Scheme of Nomination for Planning Services – Executive Director of Place’.

Approved to take no further action in respect of a technical breach of planning control concerning unauthorised internal works to a listed building.

The work undertaken is the covering of a fireplace with plasterboard in a Grade 2 Listed Building.

The Conservation Officer has advised that the fireplace is not of great architectural significance and has not identified any issues with the covering of the fireplace for heat loss prevention.

Given the above, whilst there may technically be a requirement to submit an application for Listed Building Consent, it is not considered expedient to pursue this case further.

Alternative options could be to invite an application or issue an enforcement notice. Given that the Conservation Officer has no concerns, I do not believe that it would be in the public interest to take this matter further.
