This decision is taken under delegated powers set out in Paragraph 145 of the Officer Scheme of Delegation in the Council’s constitution, which grants delegated authority to undertake all action in order to regulate any actual, perceived or potential breach of any of the Town and Country Planning Legislation including:
(c) to determine whether to issue any notice including:
(iii) any enforcement notice;
Reasons for the decision:
The development of a two storey garage outbuilding is contrary to Green Belt policy. Formal action is required to prevent the outbuilding benefiting from immunity by reason of time.
Alternative options considered:
No action- this would undermine the purposes of the Development Plan which seeks to protect Green Belt openness.
