Election of Chairman and Statement for the Procedure of the Meeting pdf icon PDF 64 KB

To elect a Chairman for the meeting and the Chairman to present and explain the procedure for the meeting.

 

2.

Declarations of Interest

To disclose any pecuniary, other registerable or personal interest as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

 

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

 

Minutes:

Cllr Parker declared an interest as one of the applicants was known to her 20 years ago.  She had sought legal advice and both Cllr Parker and the applicant were happy to continue with the hearing.

 

Cllr Fry declared an interest in having met one of the applicants at meetings that he had previously attended.  Both Cllr Fry and the applicant were happy to continue with the hearing.

3.

Urgent items

To consider any items of business which the Chairman has had prior notification and considers to be urgent pursuant to section 100B (4) b) of the Local Government Act 1972. The reason for the urgency shall be recorded in the minutes.

 

Minutes:

There were no urgent items.

4.

Exempt Business

To move the exclusion of the press and the public for the following items in view of the likely disclosure of exempt information within the meaning of paragraph 1 of Part 1 of schedule 12 A to the Local Government Act 1972 as amended by the Local Government (Access to Information) (Variations) Order 2006 – EXEMPT INFORMATION.

The public and the press will be asked to leave the meeting whilst the item of business is considered.

Decision

 

That the press and the public be excluded for the following item(s) in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

5.

Determination of the application for a new combined hackney carriage and private hire vehicle drivers' licence - Mr W

Minutes:

Proposed by Cllr Fry, seconded by Cllr Beer.

Decision: that Cllr Parker be elected to chair the application for Mr W.

 

The sub-committee considered a report to determine whether an applicant for a combined drivers' licence was a fit and proper person to hold the licence after having failed the Knowledge and Suitability Interview on three occasions during the application process.

 

The sub-committee and the applicant were invited to ask questions of the Licensing Team Leader.

 

Following sub-committee questions for the applicant, all parties were invited to sum up their case and the sub-committee adjourned to consider the application.

 

Decision:

 

To REFUSE the application for a Hackney Carriage Driver’s Licence.

 

6.

Determination of an application for a new private hire drivers' licence - Mrs W

Minutes:

Proposed by Cllr Beer, seconded by Cllr Parker.

Decision: That Cllr Fry be elected to chair the application for Mrs W.

 

The sub-committee considered a report to determine whether an applicant was “fit and proper” to hold a Private Hire Drivers Licence. The Licensing Team Leader set out the details of the application including matters referred to as part of the Disclosure Barring Service check.

 

There were no questions from the sub-committee for the Licensing Team Leader at this stage.

 

The applicant, accompanied by her son, was then given the opportunity to put her case forward.  The sub-committee and Licensing Team Leader were invited to ask questions of the applicant.

 

All parties were given the opportunity to sum up their case before the sub-committee adjourned to consider the application.

 

Decision: 

 

To GRANT the application for a Private Hire Driver’s Licence, with the usual conditions.

 

7.

Determination of an application for a new Hackney Carriage Vehicle Drivers' Licence - Mrs P

Minutes:

Proposed by Cllr Fry, seconded by Cllr Parker.

Decision: That Cllr Beer be elected to chair the application for Mrs P.

 

The sub-committee considered a report to determine whether an applicant for a hackney carriage drivers' licence was a fit and proper person to hold the licence after a recent offence was revealed during the application process.

 

There were no questions from the sub-committee at this stage.

 

The applicant was invited to put her case forward, the sub-committee and Licensing Officers present were given the opportunity to ask questions of the applicant.

 

Following an opportunity for all parties to sum up their cases the sub-committee adjourned to make their decision.

 

Decision:

 

To REFUSE the application for a Private Hire Driver’s Licence.

 

 

8.

Determination of an application for a new Hackney Carriage and Private Hire Driver's Licence - Mr F

Minutes:

Proposed by Cllr Fry, seconded by Cllr Beer.

Decision: that Cllr Parker be elected to chair the application for Mr F.

 

The sub-committee considered a report to determine whether an applicant for both a hackney carriage driver and a private hire drivers' licence was a fit and proper person to hold a licence after several convictions were revealed on the required Disclosure and Barring Service Certificate.

 

There were no sub-committee questions for the Licensing Team Leader and the applicant was invited to put his case forward.

 

The sub-committee then put their questions to the applicant, all parties were given the opportunity to sum up their cases after questioning and the sub-committee retired to make their decision.

 

Decision:

 

To GRANT the application for a Hackney Carriage and Private Hire Driver’s Licence with the usual conditions.

 

 

9.

Determination of an application for a new Private HIre Drivers' Licence - Mr B

Minutes:

Proposed by Cllr Fry, seconded by Cllr Parker.

Decision: that Cllr Beer be elected to chair the application for Mr B

 

The sub-committee considered a report to determine whether an applicant for a private hire drivers' licence was a fit and proper person to hold a licence after a caution was revealed on the required Disclosure and Barring Service Certificate.

 

The sub-committee had no questions for the Licensing Team Leader and the applicant was invited to put his case forward.  Mr B was accompanied by a member of staff from the Taxi Company who also spoke in support of his application.

 

Following the opportunity for all parties to ask questions the applicant summed up his case.  The sub-committee retired to make their decision.

 

Decision:

 

To GRANT the application for a Private Hire Driver’s Licence with the usual conditions.

 

 

 

10.

Determination of an application for a new Hackney Carriage Drivers Licence - Mr H

Minutes:

Proposed by Cllr Beer, seconded by Cllr Parker.

Decision: that Cllr Fry be elected to chair the application for Mr H

 

The sub-committee considered a report to determine whether an applicant for a Hackney Carriage drivers' licence was a fit and proper person to hold a licence after a caution was revealed on the required Disclosure and Barring Service Certificate.

 

There were no sub-committee questions and the applicant was invited to present his case.

 

The sub-committee and the Licensing Officers were invited to ask questions prior to all parties being given the opportunity to sum up their case.

 

The sub-committee retired to make their decision.

 

Decision:

 

To REFUSE the application for a Hackney Carriage Driver’s Licence.

 

 

 

 

11.

Determination of an application for a new Private Hire Drivers' Licence - Mr H

Minutes:

It was proposed by Cllr Fry, seconded by Cllr Beer.

Decision: that Cllr Parker be elected to chair the application for Mr H.

 

The sub-committee considered a report to determine whether an applicant for a private hire drivers' licence was a fit and proper person to hold a licence after a caution for two offences was revealed on the required Disclosure and Barring Service Certificate.

 

There were no questions from the sub-committee or the applicant for the Licensing Team Leader.

 

The applicant was given the opportunity to present his case and the sub-committee and Licensing Team Leader were invited to ask questions.

 

After all parties were given the opportunity to sum up their cases the sub-committee retired to make their decision.

 

Decision:

 

To GRANT the application for a Private Hire Driver’s Licence with the usual conditions and one additional condition.
