Election of Chairman and Statement for the Procedure of the Meeting pdf icon PDF 73 KB

To elect a Chairman for the meeting and the Chairman to present and explain the procedure for the meeting.

 

Minutes:

Proposed by Cllr Jon Andrews, seconded by Cllr Brian Heatley.

 

Decision: that Cllr Emma Parker be elected as chairman for the duration of the meeting.

Apologies

To receive any apologies for absence.

 

Minutes:

Apologies for absence were received from Cllrs Sarah Williams, Paul Harrison, and Kate Wheller, substituted by Cllrs Brian Heatley and Jon Andrews.

123.

Declarations of Interest

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

 

Minutes:

No declarations of disclosable pecuniary interests were made at the meeting.

Urgent items

To consider any items of business which the Chairman has had prior notification and considers to be urgent pursuant to section 100B (4) b) of the Local Government Act 1972. The reason for the urgency shall be recorded in the minutes.

125.

Exempt Business

To move the exclusion of the press and the public for the following item in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

The public and the press will be asked to leave the meeting whilst the item of business is considered.

Decision

 

That the press and the public be excluded for the following item(s) in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).  

126.

Taxi Driver Application

Minutes:

The sub-committee considered a report to determine whether the Applicant remained a fit and proper person to hold a Hackney Carriage Driver’s Licence after offences were revealed on the 6 monthly DBS check.

 

The Licensing Team Leader presented her report.

 

The Applicant was subsequently invited to put their case forward and all parties were given the opportunity to ask questions of each other and to sum up.

 

The sub-committee retired to make its decision.

 

Decision: To REVOKE the Hackney Carriage Driver’s Licence.

Taxi Driver Application

Minutes:

The sub-committee considered a report to determine whether the Applicant remained a fit and proper person to hold a Hackney Carriage Driver’s Licence after offences were revealed on the DVLA Licence Summary check.

 

The Senior Licensing Officer presented her report.

 

The Applicant was subsequently invited to put their case forward and all parties were given the opportunity to ask questions of each other and to sum up.

 

The sub-committee retired to make its decision.

 

Decision: To REFUSE the Hackney Carriage Driver’s Licence.

Taxi Driver Application

Minutes:

The sub-committee considered a report to determine whether the Applicant was a fit and proper person to hold a Private Hire Driver’s Licence after offences were revealed on the DVLA Licence Summary Check and the DBS check.

 

The Senior Licensing Officer presented his report.

 

The Applicant was subsequently invited to put their case forward and all parties were given the opportunity to ask questions of each other and to sum up.

 

The sub-committee retired to make its decision.

 

Decision: To GRANT the application for a Private Hire Driver’s Licence.   

 

129.

Non-Compliance with DBS Check

Minutes:

The Licensing Team Leader introduced the report.

 

A number of drivers had failed to respond to repeated requests to do a six-monthly DBS Check as required by the Taxi Licensing Policy adopted in April 2022.

 

Decision: to suspend the licences of those drivers with immediate effect, who had not responded to repeated requests to do a DBS Check.
