To elect a Chairman for the meeting and the Chairman to present and explain the procedure for the meeting.

 

Minutes:

Proposed by Cllr Brian Heatley, seconded by Cllr Emma Parker

 

Decision: that Cllr Les Fry be elected as Chairman for the duration of the meeting.

Apologies for absence were received from Cllrs David Taylor and Mike Dyer, substituted by Cllrs Emma Parker and Brian Heatley.

Declarations of Interest

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

142.

Temporary Event Notice - Chic Bar & Club pdf icon PDF 177 KB

A Temporary Event Notice has been served on the Council to extend the hours of Chic Bar and Club in Weymouth. The Notice has been considered by the Police and the Council’s Environmental Protection team. The Police have served Objection Notice. A Licensing Sub-Committee must consider the Notice and the Objection Notice at a public hearing.

The Senior Licensing Officer introduced the report for a Temporary Event Notice (TEN), which had been served on the council to extend the hours of Chic, Bar and Club for the period from 0200 hours on Sunday 2 April 2023 until 03:30 hours on Sunday 2 April 2023. The Notice covers the sale of alcohol and regulated entertainment and was for 440 attendees. The notice had been considered by Environmental Health. Dorset Police served an objection notice under the crime and disorder objective.

 

There were no questions for the Senior Licensing Officer.

 

The applicant was invited to put forward their case.

 

The applicant informed that previous TEN applications had come to committee before and were successful. He requested that the condition for no re-entry past 01:30 be changed to 02:30 due to issues with DJ’s not being able to enter or re-enter the night club after 01:30 on New Year’s.

 

Cllrs asked the applicant on timings and clarified that only hours on the TEN applications could be considered and conditions on the licence would have to stay the same. The term entry and re-entry were discussed.

 

The Senior Licensing Officer clarified that the condition for 01:30 last entry would have to stay the same and could not be extended to 02:30.

 

Cllrs asked the applicant questions on security and how he will keep people safe and what events will be held.

 

The applicant responded to Cllrs questions regarding keeping people safe by working closely with the police and the council, in the last seven months since the club re-opened, they had not had to call the Police or the ambulance service at all, the venue had always been a late-night venue and the earlier closing times were impacting his business, local dealers do not come near the club and that he had been a licensee for 27 years.

 

The Licensing Officer for Dorset Police raised concerns that the licensing objective for the prevention of crime and disorder would be undermined by this TEN if the conditions from the premises licence were not attached.

 

She confirmed that conditions were working well, and after discussions with the applicant they would be content if all conditions, with the exception of the condition relating to entry and re-entry after 01:30 hrs, were added to the TEN.

 

All applicants were given the opportunity to sum up prior to the sub-committee adjourning to make their decision.

143.

Exempt Business

To move the exclusion of the press and the public for the following item in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

The public and the press will be asked to leave the meeting whilst the item of business is considered.

That the press and the public be excluded for the following item(s) in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

 

Decision: To ISSUE A NOTICE (STATEMENT OF CONDITIONS) to add the conditions from the Chic Bar and Club Premises Licence, except for condition 1.1, which relates to no entry or re-entry to the premises after 01:30 hrs, to the TEN.
