To elect a Chair for the meeting and the Chair to present and explain the procedure for the meeting.

Proposed by Cllr Haynes, seconded by Cllr Somper.

Decision: that Cllr Bown be elected as Chair for the duration of the meeting.

No apologies for absence were received at the meeting.

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

No declarations of disclosable pecuniary interests were made at the meeting.

An application has been made for a new premises licence for Lovitaly, 3 Church Street, Wimborne, Dorset. The application has been out to public consultation. A Licensing Sub-Committee must consider the application and representations at a public hearing.

The Senior Licensing Officer introduced the report. The application was for the sale of alcohol on and off the premises Monday to Sunday 9am to 11pm. There had been no representations received from the responsible authorities. Two representations were received from members of the public relating to the potential for crime, antisocial behaviour and noise. Representations made that related to the premises and highway issues were not relevant. The requirement for a sitting out licence was covered under a different licensing process and would be dealt separately if applied for.

Cristina Cavalleri and Louise Brice (solicitor) spoke on behalf of the applicant company. They explained that the premises would be a small Italian coffee shop/bistro lounge serving breakfast and lunch to 3 pm or 4 pm. There would only be a private event if requested and would mainly be wine tasting in the evenings up to 11.  The premises would only sell expensive wine and there was already a restaurant in Ringwood which operated in the same way, in which no antisocial behaviour had been experienced. The purpose of the restaurant was to have a nice lunch with a glass of wine with a meal. They informed that there would be no antisocial behaviour, and they did not see why there would be any noise at lunch time as it was a small place and there would not be a massive queue outside. The clientele that would frequent the premises were not the type of people to cause antisocial behaviour. There would be specialised beers sold in bottles, no draft beers and no cocktails. She stated that any issues with tables and chairs on the highway had related to the previous lease holder.

All parties were given the opportunity to have their say and sum up.

Decision:

To GRANT the Premises Licence with the usual mandatory conditions and the conditions consistent with the Operating Schedule.

To consider any items of business which the Chairman has had prior notification and considers to be urgent pursuant to section 100B (4) b) of the Local Government Act 1972. The reason for the urgency shall be recorded in the minutes.

There were no urgent items.

To move the exclusion of the press and the public for the following item in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended). The public and the press will be asked to leave the meeting whilst the item of business is considered.
