Election of Chairman and Statement for the Procedure of the Meeting pdf icon PDF 103 KB

To elect a Chairman for the meeting and the Chairman to present and explain the procedure for the meeting.

 

Minutes:

Proposed by Cllr Jones, seconded by Cllr Cocking.

 

Decision: that Cllr Emma Parker be appointed Chairman for the duration of the meeting.

Declarations of Interest

To receive any declarations of interest.

Minutes:

No declarations of disclosable pecuniary interests were made at the meeting.

Variation for The Dolphin Inn, Gillingham pdf icon PDF 107 KB

An application has been made to vary the licence at The Dolphin Inn at Peacemarsh in Gillingham. The application has been out to public consultation and has attracted a representation. A Licensing Sub-Committee must consider the application and representations at a public hearing.

The Licensing Team Leader presented the application to vary the licence at The Dolphin Inn at Peacemarsh, Gillingham to include the carpark.  This would enable an outside catering unit from which alcohol could be served.  There were no representations from the Responsible Authorities.

 

There were no questions at this stage for the Licensing Team Leader.

 

The Applicant was then invited to present his statement.  He re-iterated that he simply wanted the facility to sell alcohol outside, the number of tables in the garden area would stay the same and no licencing objectives would be breached.

 

The sub-committee members were invited to ask questions of the Applicant,

The Licensing Team Leader had no questions.

The Objector was invited to ask questions of the Applicant.

 

The Objector was invited to present his case.  His concerns were focused around the noise implications, timings of usage of the garden and smoke from patrons smoking near the boundary to his home.

The sub-committee were invited to ask questions of the Objector.

The Licensing Team Leader had no questions for the Objector.

 

The Applicant had no questions but responded to the Objector’s concerns regarding the gardens.  He advised that he would be happy to compromise on a closing time of 10.00pm at weekends in the rear garden and the benches could be monitored and made non-smoking. This should alleviate some of the problems.  The Applicant wanted the pub to look nice and attract people.  The garden was mainly used as an eating area

 

After a last opportunity for further questions, all participants were invited to sum up their cases before the sub-committee retired to make their decision.

Urgent items

To consider any items of business which the Chairman has had prior notification and considers to be urgent pursuant to section 100B (4) b) of the Local Government Act 1972. The reason for the urgency shall be recorded in the minutes.

There were no urgent items.

82.

Exempt Business

To move the exclusion of the press and the public for the following item in view of the likely disclosure of exempt information within the meaning of paragraph x of schedule 12 A to the Local Government Act 1972 (as amended).

The public and the press will be asked to leave the meeting whilst the item of business is considered.

Decision: That the press and the public be excluded for the following item(s) in view of the likely disclosure of exempt information within the meaning of paragraph 3 of schedule 12 A to the Local Government Act 1972 (as amended).

 

The Committee retired to make their decision.

 

Decision: To GRANT the variation of the Premises Licence to extend the licenced area to include the outside area of the premises as shown in the application plan, with the addition of a new condition and the amendment of the existing Condition 3 as follows:

 

1.     The use of the outside areas for all activities shall cease at 2200 hours. (Amendment to Condition 3)

 

2.     Smoking will not be permitted at the tables on the grassed area as shown on the application plan.
