To elect a Chair for the meeting and the Chairman to present and explain the procedure for the meeting.

 

Proposed by Cllr Williams and seconded by Cllr Shortell.

 

Decision: That Cllr Beer be elected as Chair for the duration of the meeting.

To receive any apologies for absence.

 

No apologies for absence were received at the meeting.

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

 

No declarations of disclosable pecuniary interests were made at the meeting.

An application has been made for a new premises licence for The Rivers Edge, 21 Lewis Way, Wimborne. The application has been out to public consultation.  Representations have been received. A Licensing Sub-Committee must therefore consider the application and representations at a public hearing. 

The Senior Licensing Officer outlined the application which was for a new premises licence for a café. Dorset Police had requested a number of conditions to be added to the licence should it be granted and these were outlined in the report.

 

The applicants explained that they had worked in the service industry together for a number of years and had been offered an opportunity to run a café underneath the offices for Wyatt Homes in Wimborne. They stated that their main custom would come from the breakfast and lunch trade for office workers, however they had applied to be open for two evenings a week to provide flexibility for the business. In response to questions from the sub-committee they confirmed that there would be designated smoking area away from the site and customers wouldn’t be able to take their drinks outside with them. They also stated that they would have signage in place to remind customers to be respectful of the neighbours.

 

Decision

 

To GRANT the Premises Licence with the with the usual mandatory conditions, the conditions consistent with the Operating Schedule and the conditions requested by Dorset Police.

 

a.    The following Mandatory Conditions:

 

1. Supply of Alcohol (s19(2)&(3))

No supply of alcohol may be made under the premises licence –

(a) at a time when there is no designated premises supervisor, or

(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence has been suspended.

Every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

 

2. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either—

(a) a holographic mark, or

(b) an ultraviolet feature.

 

3. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

 

4. For the purposes of the condition set out in paragraph 3—

(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

(b) “permitted price” is the price found by applying the formula— P=D+(DxV)

The application has been out to public consultation.  Representations have been received. A Licensing Sub-Committee must therefore consider the application and representations at a public hearing. 

The Senior Licensing Officer outlined the application which was for a new premises licence for Briathwaites Board and Box, 2 Franwill Industrial Estate, Pimperne. It was explained that Dorset Police had requested a number of conditions to be added should the licence be granted and the applicant had agreed to the conditions.

 

The applicants explained that the establishment would offer takeaway hot food and drinks to serve the residents of Pimperne and that they would also offer a delivery service.

 

Decision

 

To GRANT the Premises Licence with the usual mandatory conditions and the conditions requested by Dorset Police.
