To elect a Chairman for the meeting and the Chairman to present and explain the procedure for the meeting.

 

It was proposed by Cllr Monks and seconded by Cllr Williams that Cllr Beer be elected as Chair.

 

Decision: That Cllr Beer be elected as Chair for the duration of the meeting.

To receive any apologies for absence.

 

No apologies for absence were received at the meeting.

To disclose any pecuniary, other registrable or non-registrable interests as set out in the adopted Code of Conduct. In making their disclosure councillors are asked to state the agenda item, the nature of the interest and any action they propose to take as part of their declaration.

If required, further advice should be sought from the Monitoring Officer in advance of the meeting.

 

No declarations of disclosable pecuniary interests were made at the meeting.

 

An application has been made for a variation of the premises licence for 8 Copper Street, Brewery Square, Dorchester. The application has been out to public consultation.  Representations have been received. A Licensing Sub-Committee must therefore consider the application and representations at a public hearing. 

The Senior Licensing Officer outlined the application which was for a variation of a premises licence for 8 Copper Street, Brewery Square, Dorchester to extend the hours of alcohol sales and allow films to be shown on the premises. Three representations had been received from members of the public objecting to the application, and four representations had been received in support of the application.

 

Mr Burrell addressed the sub-committee on behalf of the applicant. He stated that most noise and anti-social behaviour in the area comes from the train station opposite to the premises rather than the premises itself and that signage could be installed to ask customers to be respectful of neighbours when leaving the premises. It was understood that some neighbours had objected to the application, however he explained that some residents had expressed support for the application and enjoyed the mix of commercial and residential use in Brewery Square. The business was committed to running a well organised and respectful establishment and the later opening hours on Monday, Tuesday and Wednesday would rarely be used and likely only in the case of there being a specific event on those days. In addition, the application would allow the business to avoid using Temporary Event Notices in the future when they wish to operate outside of their usual hours.

 

In response to questions from members the applicant provided the following responses:

·       In the event of noise complaints, the business works with the management of Brewery Square and in the past has attempted to conduct noise assessments from neighbouring properties but has been refused access.

·       There were two events held a year where speakers were used outside, and these were covered by a Temporary Event Notice.

·       The venue could hold a maximum of 40 people inside.

·       The business had consulted with Environmental Health and had a noise management plan in place.

 

All parties were given the opportunity to have their say and sum up.

 

Decision: To VARY the Premises Licence as applied for to permit the following:

To remove the condition which reads, ‘There will be no external loudspeakers’ and replace it with, ‘External loudspeakers will only operate on weekends proceeding a bank holiday and will be monitored for noise levels in accordance with guidelines from Environmental Health’.
