Application for a Variation of a Premises Licence for E Bike Café, Weymouth.

An application has been made for a variation of a premises licence for E Bike Café, 9a Custom House Quay, Weymouth. The application has been out to public consultation.  A Licensing Sub-Committee must consider the application and representations at a public hearing. 

Minutes:

The Senior Licensing Officer introduced the report. The current licence for the Premises permitted the sale of alcohol Monday to Sunday from 9am to 8pm. The Applicant had applied to vary the licence to amend the permitted hours for the sale of alcohol to 9am to 11pm Monday to Sunday, and to add plays, late night refreshment, films and live and recorded music during the same days and hours.

 

The Applicant amended their application following discussions with their landlord. The hours for the sale of alcohol and regulated entertainment were amended to Monday to Saturday 9am to 8pm and Sunday 8.30am to 6pm. Non-standard hours were requested for twenty occasions per annum to extend to 11pm, with an extension for New Year’s Eve to half past midnight.

 

Ms Parker addressed the Sub-Committee on behalf of the Applicant. She informed that hospitality was a tricky industry to be in and wanted to diversify in a creative way to stay in business. These extra hours would help increase revenue and turnover. She was conscious of the people that live above the noise but explained that there would only be a small number of events and no speakers in the outside area, and she would be present at every event.

 

Mr Jones a representative of the landlord and a resident in the building, covered the discussions he had with the applicant that led to the revised application. He explained that the Café was a good neighbour, and he accepted the fact that it needed to diversify to survive. The residents did not want to see events being held every week, but they felt that twenty events per year would be acceptable. He didn’t think that the changes at the Premises would lead to any issue with anti-social behaviour.

 

 

All parties were given the opportunity to have their say and sum up. 

 

Decision:

 

To VARY the Premises Licence to amend the times that alcohol can be sold (on and off sales), to add plays, films, live and recorded music and to add conditions as follows:

 

Sale of Alcohol (on and off the Premises)

Monday to Saturday 08:00 to 20:00 hours

Sunday 08:30 to 18:00 hours

From the end of permitted hours on New Year’s Eve until 00:30 hours on New Year’s Day.

Non-standard timings: On 20 (twenty) occasions per annum from the end of permitted hours to 23:00 hours.

 

Plays (Indoors and outdoors)

Monday to Saturday 08:00 to 20:00 hours

Sunday 08:30 to 18:00 hours

From the end of permitted hours on New Year’s Eve until 00:30 hours on New Year’s Day.

Non-standard timings: On 20 (twenty) occasions per annum from the end of permitted hours to 23:00 hours.

 

Films (Indoors)

Monday to Saturday 08:00 to 20:00 hours

Sunday 08:30 to 18:00 hours

New Conditions added to the licence:

 

  1. The last sale of alcohol 20-30 minutes before close.

 

  1. All staff working at the Premises concerned with the sale of alcohol shall be trained in accordance with an accredited training scheme on the law relating to prohibited sales, the age verification policy adopted by the Premises and the conditions attaching to the Premises Licence. Refresher training shall be provided at least once every 6 months. A record shall be maintained of all staff training and that record shall be signed by the person receiving the training and the trainer. The records shall be kept for a minimum of 12 months and made available for inspection by Police, Licensing or other authorised officers.

 

  1. An incident log shall be kept at the Premises. The log shall include the date and time of the incident and the name of the member of staff who has been involved. and made available on request to an authorised officer of the Council or the Police, which shall record the following:

 

This log to be checked on a weekly basis by the Designated Premise Supervisor of the Premises.

 

  1. Challenge 25 shall be operated at the Premises where the only acceptable forms of identification are (recognised photographic identification cards, such as a driving licence or passport I Holographically marked PASS scheme identification cards). Appropriate signage advising customers of the policy shall prominently displayed in the Premises.

 

  1. A CCTV system shall be installed to cover all entry and exit points enabling frontal identification of every person entering in any light condition. The CCTV system shall continually record and cover areas where alcohol is kept for selection and purchase by the public, whilst the Premises is open for licensable activities. It shall operate during all times when customers remain on the Premises. All recordings shall be stored for a minimum period of 31days with correct date and time stamping. Recordings shall be made available immediately upon the request of Police or an authorised officer of the Council throughout the preceding 31 day period. The CCTV system shall be updated and maintained according to Police recommendations.

 

  1. A staff member from the Premises who is conversant with the operation of the CCTV system shall be on the Premises at all times when the Premises are open to the public. This staff member must be able to show a Police or authorised Council officer recent data or footage with the absolute minimum of delay when requested.

 

  1. CCTV shall be downloaded on request of the Police or authorised officer of the Council. Appropriate signage advising customers of CCTV being in operation, shall be prominently displayed in the Premises.

 

  1. A documented check of the CCTV shall be completed weekly to ensure all cameras remain operational and the 31 days storage for recordings is being maintained.

 

  1. The Designated Premises Supervisor will risk assess the need for door supervision. Door supervisors will be provided in such numbers, between such times and on such dates as required by the risk assessment.

 

  1. Toughened glassware to be used for all external areas after 21:00.

 

External tables to be cleared of all crockery and glassware on a regular basis.
