An application has been made for a variation of the premises licence for the Slug and Lettuce, 56-57 St Thomas Street, Weymouth. The application has been out to public consultation.  Representations have been received. A Licensing Sub-Committee must therefore consider the application and representations at a public hearing. 

The Sub-Committee was addressed by the Senior Licensing Officer who outlined the application. The written report included the application form in which the applicant had requested changes to the times of opening and regulated entertainment, together with an amendment to a condition in Annex 2 of the licence to move from Challenge 21 to Challenge 25 and to re-orientate the bar servery within the Premises.

 

The Senior Licensing Officer explained that no representations had been received from the Responsible Authorities, but a member of the public had submitted a representation relating to potential noise issues. They were concerned about noise when people left the premises and wanted customers to be made aware that people lived nearby.

 

The Senior Licensing Officer advised the Sub-Committee that conditions on the licence already required a risk assessment for the need for door supervisors, a refusals log and notices asking people to leave quietly. No complaints had been received about the premises relating to noise.

 

The Sub-Committee was addressed by Dianna Freeman on behalf of the Applicant. She stated that they had purchased the pub recently and had closed it for substantial refurbishment. Ms Freeman advised that they wanted to move the bar and reduce the opening hours. The premises had been an established venue prior to their purchase, training would be given to staff and notices would remind customers to leave the premises quietly. In response to questioning Ms Freeman said that customers tended to leave the premises gradually rather than all at once at the end of the evening.

 

All parties were given the opportunity to have their say and sum up.

 

Decision

 

To VARY the Premises Licence to permit the re-orientation of the bar servery as set out in the application plan, to amend the Licence Condition at Annex 2 and to reduce the hours for Regulated Entertainment and opening times for the premises as follows:

In Annex 2 of the Premises Licence delete the wording: ‘A proof of age scheme such as Challenge 21 will be operated at the premises where the only acceptable forms of identification are photographic identification cards such as a driving licence or passport’ and replace it with: ‘Any person under the age of 25 wishing to purchase alcohol will be asked to produce ID before such a sale is made. Acceptable ID, picture driving licence, passport or PASS approve ID card and armed forces ID card’.

Appendix 1. MANDATORY CONDITIONS

The licence is granted subject to the Mandatory conditions for sale of alcohol as set out in the Licensing Act 2003 as amended by the Licensing Act 2003 (Mandatory Licensing Conditions) Order 2010 and Order 2014.

 

Mandatory Conditions and Conditions Consistent with the Operating Schedule are outlined in the officers report.

 

Annex Prevention of crime and disorder

1. A CCTV system shall be installed at the premises and maintained in good working order and used at all times when the premises are open for licensable activities.

 

2. Any CCTV footage shall be held for 31 days and shall be made available to an officer of the Licensing Authority or Police on reasonable request.

 

3. Where Pubwatch exists covering the area of which the premises is situated then the DPS or other nominated employee shall participate in Pubwatch.

 

4. The need for door supervisors will be assessed by way of risk assessment and cognisance will be taken of any Police advice.

 

5. The premises shall maintain a written drugs policy, which shall be made available to the Police or an authorised officer of the Council upon request.

 

6. An incident log book (which may be electronic) shall be kept on the premises and made available on request to an authorised officer of the Council or Police which will record the following:- a) Any incidents of disorder b) Any seizures of drugs or offensive weapons c) Any ejections of patrons The premises shall maintain a written dispersal policy, which shall be made available to the Police or an authorised officer of the Council upon request.

 

Public safety

 

7. The Premises licence holder understands their obligations under existing legislation and takes their responsibility seriously.

 

The prevention of public nuisance

 

8. Reasonable steps will be taken to recognise the rights of local residents and notices will be displayed at the premises exits requesting customers to leave quietly and reminding them that they are in a residential area. The premises shall maintain a noise limiter at the premises and all amplified music shall be subject to the control of the noise limiter. Doors and windows of the premises shall be kept closed when regulated entertainment in the form of live or DJ led music is being played, save for access and egress.

 

 

Protection of children from harm

 

9. Any person under the age of 25 wishing to purchase alcohol will be asked to produce ID before such a sale is made. Acceptable ID, picture driving licence, passport or PASS approve ID card and armed forces ID card.

 

10. A log (which may be electronic) shall be kept detailing all refused sales of alcohol. The log shall include the date and time of the refusal and the name of the member of staff who refused the sale. A copy of the log or electronic report shall be made available upon reasonable request.

 

11. All bar staff to receive appropriate training in relation to alcohol sales prior to commencing their duties. This will include the premises licence conditions, underage sales policy and other relevant licensing matters. Training documents (which may be in an electronic format) shall be made available to an authorised police officer and licensing authority officer upon request.
